These Terms and Conditions of Sale ("Terms") outline the agreement between Elegant Collections Pty Ltd ("the Seller") and you ("the Buyer") regarding the purchase of goods. By purchasing from Elegant Collections Pty Ltd, you agree to comply with these Terms.

1. DEFINITIONS

1.1 "Goods" refers to the products available for sale by Elegant Collections Pty Ltd. 1.2 "Order" denotes a request placed by the Buyer to purchase Goods from the Seller. 1.3 "Price" refers to the cost of the Goods as set by the Seller. 1.4 "Delivery Address" is the location specified by the Buyer for the shipment of Goods.

2. GENERAL

2.1 These Terms & Conditions establish a binding agreement between you and Elegant Collections Pty Ltd concerning your purchase. 2.2 Goods are designed for domestic use unless otherwise indicated. 2.3 The Seller reserves the right to amend these Terms & Conditions. The version of the Terms & Conditions in effect at the time of purchase will apply. Updates will be published on the Seller’s website and made available in-store. 2.4 Any provision of these Terms & Conditions that is determined to be void or unenforceable will be severed to the necessary extent without impacting the remaining provisions. 2.5 These Terms & Conditions are governed by the laws of the Australian State or Territory in which the purchase occurs. Any disputes will be handled under the jurisdiction of the courts in that State or Territory.

3. SITE USE

3.1 The Seller’s website may include links to third-party sites for user convenience. However, the Seller does not control or endorse the content, security, or privacy practices of these external websites and is not responsible for any associated risks. 3.2 The Buyer must ensure that their use of the website complies with all applicable laws and regulations. 3.3 The Buyer is responsible for taking necessary precautions to safeguard their devices when accessing the Seller’s website. The Seller does not accept liability for any damage caused by viruses, malware, or harmful digital elements that may arise from website use.

4. PRODUCT SPECIFICATIONS

4.1 The details and features of the Goods, as described on the website or in promotional materials, may be updated or modified at any time without prior notice. 4.2 Any measurements or weights provided for the Goods are approximate and are based on fully assembled and unpackaged items. 4.3 The colours displayed on the Buyer’s screen may not precisely match the actual product colours due to variations in device settings, screen calibration, and display capabilities. While efforts are made to ensure accuracy, slight differences in colour representation may occur.

5. PURCHASE POLICY

5.1 Prices displayed online, and in-store are in Australian dollars and include GST. Payments are accepted via Visa, MasterCard, cash, Elegant Collections Pty Ltd gift cards/store credit, AfterPay, and Zip payments. Promotional prices will be displayed alongside the standard retail price. Prices may change without notice. 5.2 Payments are securely processed through an authorized global payment provider, and credit card details are not stored post-transaction. A purchase confirmation will be sent via email. It is the Buyer’s responsibility to provide accurate contact details. 5.3 Online purchases require full payment, inclusive of GST, before processing. In-store purchases require a minimum deposit, covering delivery fees and GST. 5.4 Price matching is available during promotions for orders that have not yet been delivered or collected. Requests must be made within 7 days of the promotional period. If the invoice is paid in full, a credit note for the price difference will be issued. 5.5 Delivery fees are determined at checkout for online orders or at the time of purchase in-store. 5.6 Once placed, special orders cannot be cancelled or altered. A cancellation fee of 30% of the total item value applies. 5.7 Orders will be held for up to 4 weeks from product availability. After this period, storage is the Buyer’s responsibility and will result in storage fees per week. 5.8 Prices may fluctuate due to supply chain costs without prior notice. 5.9 All orders must be paid in full before delivery or collection can be arranged. 5.10 Discounts cannot be applied retrospectively. Credit Notes or Gift Cards must be presented at the time of purchase. 5.11 Melbourne and Sydney Metro orders are typically delivered within 7 days of availability. Estimated arrival times may change, and the Seller will provide updates when available. 5.12 Elegant Collections Pty Ltd store credits are valid for 6 months from the date of issue. Any unused balance upon expiry is forfeited. Extensions are not permitted. 5.13 Quotes remain valid for two weeks or until the specified expiry date. Only written system-generated quotes will be honoured. Word of mouth quotes will not be accepted. 5.14 The Seller reserves the right to reject or modify orders due to product discontinuation, excessive shipping costs, pricing errors, fraud detection, or other necessary considerations. 5.15 Promotional discounts do not apply to third-party services or consignment products.

6. DELIVERY AND STORE PICKUP

6.1 Delivery service is to the front door of the provided address. If circumstances allow, and at the discretion of the delivery personnel, items may be brought inside on the ground floor. Delivery does not include assembly or packaging removal. The Seller is not responsible for any damages to the Buyer’s property due to challenging access conditions. It is the Buyer’s responsibility to ensure that items fit in the intended space and that access is not obstructed. Delivery time estimates are not guaranteed.

6.2 In-Store Purchases: Delivery fees are non-refundable, and if the Buyer requests pickup, a fee ranging from $29.99 to $49.99 will be applicable if the item was arranged for transfer to a specific store.

6.3 Online Purchases: All online sales are final. No refunds, exchanges, or credit notes will be offered for change-of-mind purchases.

6.4 Damaged Items: Upon receiving your order, please inspect the packaging immediately. If you notice any damage, note it when signing for delivery and contact us at accounts@elegantcollections.com.au within 7 business days of receiving the item. Include photos of the damage and packaging, describe the issue, and mention your order number. Depending on the circumstances, a refund, repair, or replacement will be arranged accordingly. Keep the original packaging to ensure the item is securely transported. In certain cases, insured courier companies may not collect damaged products. If this occurs, our team will notify you, and it will be your responsibility to dispose of the damaged item(s) accordingly. Depending on the case, a refund, repair, or replacement will be arranged.

7. CHANGE OF MIND POLICY

7.1 Online Purchases: All online sales are final. No refunds, exchanges, or credit notes will be offered for change-of-mind purchases.

7.2 In-Store Purchases: If a Buyer changes their mind about a purchase within 14 days from the date of purchase, they may opt for a store credit (valid for 180 days) or exchange items to the original order value. If the Buyer chooses a refund instead of a store credit, a 20% restocking fee will be applied to the total value of the returned items.

7.3 Special Orders: Special orders require a 30% deposit and cannot be cancelled or altered once placed. 

7.4 Non-Returnable Items: Opened mattresses, assembled items, special orders, and used products cannot be returned for change of mind. Ex-display and floor stock items are also non-refundable and non-exchangeable.

7.5 Goods must be returned within 14 days of receipt in their original, unopened packaging. The Buyer is responsible for return shipping costs, which must be prepaid. Delivery fees are non-refundable, and if the Buyer requests pickup, a fee ranging from $29.99 to $49.99 will be applicable if the item was arranged for transfer to a specific store.

7.6 Refunds are processed according to Consumer Affairs Victoria guidelines. Requests must be emailed to accounts@elegantcollections.com.au with order details and bank information if applicable. Approved refunds will be processed within a specified timeframe.
